Two former FBI leaders face court over Hunter Biden laptop testimony

Two former FBI officials stand accused of lying to members of Congress regarding their involvement in investigations tied to Hunter Biden. Nikki Floris and Bradley Benavides are scheduled to appear in federal court in Washington on Tuesday for a preliminary hearing. Their legal teams have characterized the criminal case as baseless and driven by political timing.
The Justice Department announced the prosecution on Friday. This action marks the latest in a series of high-profile investigations launched by the department in the weeks leading up to the midterm elections. The government is pursuing a rare criminal case against former employees of the bureau. The charges stem from statements made in 2023. In those statements, Floris and Benavides denied having contemporaneous knowledge of a laptop associated with Hunter Biden. They also denied participating in internal FBI discussions about that device.
The laptop issue first gained public attention in 2020. The New York Post reported that it had obtained a hard drive from a laptop left at a computer repair shop in Delaware. The publication said it received the drive from Rudy Giuliani, a close ally of President Donald Trump. The reported contents included emails suggesting foreign business dealings by Hunter Biden. The circumstances of the laptop's discovery sparked debate. Democrats and former intelligence officials raised concerns about possible Russian involvement. This concern was fueled by the Trump administration's own intelligence assessment that Moscow sought to undermine Joe Biden's candidacy.
John Ratcliffe, the national intelligence director at the time, moved to address those concerns. He stated there were no signs the laptop was connected to Russian actors. The FBI did not add to his comments. The bureau subsequently investigated Hunter Biden on gun and tax charges. Those investigations led to felony convictions. President Joe Biden pardoned his son in late 2024.
Floris and Benavides led the Foreign Influence Task Force within the FBI. The group was created during the first Trump administration to monitor influence campaigns by foreign nations. These campaigns aimed to spread disinformation and sow discord. In August 2020, the two officials briefed Republican Senators Chuck Grassley and Ron Johnson. The senators were conducting their own inquiry into Hunter Biden's work in Ukraine. News of the briefing leaked, leading the senators to criticize the FBI. They argued the bureau had linked their investigation to Russian disinformation efforts.
Defense lawyers plan to challenge the legal process at Tuesday's hearing. They will point to the fact that the officials were charged via a criminal complaint signed by a magistrate judge. This method is less common than an indictment voted on by a grand jury. Reports indicate the Justice Department has had difficulty securing grand jury indictments in other high-profile cases in the nation's capital. The defense maintains that their clients did not commit any wrongdoing.
The Foreign Influence Task Force was disbanded in February 2025. Then-Attorney General Pam Bondi led the effort to end the unit. Congressional Republicans had long criticized the task force. They argued it worked to discredit investigations into the Biden family. The current prosecution revives those tensions. The case will proceed with a hearing focused on the preliminary charges.
The court date falls on Tuesday in Washington's federal court. The prosecution seeks to establish that the former officials provided false testimony to lawmakers. The defense will contest the evidence and the manner in which the charges were filed. The outcome of the hearing will determine the next steps in this legal proceeding.
